Terms & Conditions - the basics

These Terms & Conditions (“T&C”) establish the legal relationship between Back Construction (“Company,” “we,” “us,” or “our”) and any individual or entity (“Client,” “you”) engaging with our website, requesting services, or entering into a service agreement.

By accessing our website or hiring Back Construction, you agree to be bound by these Terms.

1. Use of Website

  • You agree to use this website only for lawful purposes.

  • You may not use this website in any way that could damage, disable, or impair its functionality.

  • We reserve the right to restrict or terminate access to any user at our discretion.

Back Construction provides construction-related services including, but not limited to:

  • Custom construction services

All services are subject to availability and formal written agreement.

3. Estimates, Contracts, and Scope of Work

  • All estimates are non-binding until accepted in writing.

  • A formal agreement, estimate, or invoice will define the scope of work.

  • Any work outside the agreed scope requires a written change order and may result in additional charges.

4. Payment Terms

  • Payment terms will be specified in the estimate or contract.

  • Deposits may be required before work begins.

  • Failure to make timely payments may result in:

    • Suspension of work

    • Late fees

    • Legal action or lien placement where permitted by law

5. Scheduling and Delays

  • Project timelines are estimates and may be affected by:

    • Weather conditions

    • Material availability

    • Permit approvals

    • Unforeseen site conditions

Back Construction is not liable for delays caused by factors outside of its control.

6. Client Responsibilities

The Client agrees to:

  • Provide accurate project information

  • Ensure safe and reasonable access to the work site

  • Obtain any required permissions (unless otherwise agreed)

  • Remove personal property from work areas

Failure to meet these responsibilities may result in delays or additional charges.

7. Warranties and Workmanship

  • Back Construction warrants that work will be performed in a professional and workmanlike manner.

  • Any additional warranties (if provided) will be specified in writing.

  • This warranty does not cover:

    • Normal wear and tear

    • Damage caused by misuse, neglect, or third parties

8. Limitation of Liability

To the fullest extent permitted by law:

  • Back Construction shall not be liable for indirect, incidental, or consequential damages.

  • Our total liability shall not exceed the amount paid for the services provided.

9. Intellectual Property

All content on this website, including text, images, logos, and designs, is the property of Back Construction and may not be used without written permission.

10. Third-Party Services

Our website or services may include links or integrations with third-party providers (e.g., payment processors). We are not responsible for the content, policies, or practices of those third parties.

11. Right to Modify Services or Terms

Back Construction reserves the right to:

  • Unsafe or unreasonable conditions are present

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Ohio.

14. Mechanics’ Lien Rights (Ohio)

In accordance with Ohio Revised Code Chapter 1311, Back Construction reserves the right to file a Mechanics’ Lien against the property where labor or materials have been furnished if payment is not received in full.

  • By entering into an agreement with Back Construction, the Client acknowledges and agrees that:

    • Back Construction has the legal right to file a lien for unpaid labor, materials, services, or equipment provided.

    • This lien may be filed against the property improved by the work performed.

  • The Client understands that:

    • A Mechanics’ Lien may encumber the property title and could affect the ability to sell or refinance the property.

    • The lien will remain in effect until the outstanding balance is paid or otherwise resolved.

  • Back Construction will comply with all applicable Ohio lien laws, including:

    • Filing within required statutory deadlines

    • Providing any required notices, if applicable

  • The Client agrees to be responsible for:

    • All unpaid balances

    • Any costs associated with collection, including reasonable attorney’s fees, court costs, and lien filing expenses, where permitted by law

  • Back Construction reserves the right to:

    • Suspend or terminate work for nonpayment

    • Pursue all legal remedies available, including lien enforcement and foreclosure actions if necessary
